Personas criminalmente responsables de los delitos y faltas


Según el Código Penal Español:

Art 27

Son responsables criminalmente de los delitos y faltas los autores y los cómplices.

Art 28

Son autores quienes realizan el hecho por sí solos, conjuntamente o por medio de otro del que se sirven como instrumento.

También serán considerados autores:


Los que inducen directamente a otro u otros a ejecutarlo.
Los que cooperan a su ejecución con un acto sin el cual no se habría efectuado.

Art 29

Son cómplices los que, no hallándose comprendidos en el artículo anterior, cooperan a la ejecución del hecho con actos anteriores o simultáneos

Circunstancias modificativas de la responsabilidad criminal


Causas que eximen de la responsabilidad criminal

Art 19

Lomenores de dieciocho años no serán responsables criminalmente con arreglo a este Código.
Cuando un menor de dicha edad cometa un hecho delictivo podrá ser responsable con arreglo a lo dispuesto en la Ley que regule la responsabilidad penal del menor.

Art 20

Están exentos de responsabilidad criminal:

1 - El que al tiempo de cometer la infracción penal, a causa de cualquier anomalía o alteración psíquica, no pueda comprender la ilicitud del hecho o actuar conforme a esa comprensión (ver art 60 al final)

El trastorno mental transitorio no eximirá de pena cuando hubiese sido provocado por el sujeto con el propósito de cometer el delito o hubiera previsto o debido prever su comisión.

2 - El que al tiempo de cometer la infracción penal se halle en estado de intoxicación plena por el consumo de bebidas alcohólicas, drogas tóxicas, estupefacientes, sustancias psicotrópicas u otras que produzcan efectos análogos, siempre que no haya sido buscado con el propósito de cometerla o no se hubiese previsto o debido prever su comisión, o se halle bajo la influencia de un síndrome de abstinencia, a causa de su dependencia de tales sustancias, que le impida comprender la ilicitud del hecho o actuar conforme a esa comprensión.

3 - El que, por sufrir alteraciones en la percepción desde el nacimiento o desde la infancia, tenga alterada gravemente la conciencia de la realidad.

4 - El que obre en defensa de la persona o derechos propios o ajenos, siempre que concurran los requisitos siguientes:

1º - Agresión ilegítima. En caso de defensa de los bienes se reputará agresión ilegítima el ataque a los mismos que constituya delito o falta y los ponga en grave peligro de deterioro o pérdida inminentes. En caso de defensa de la morada o sus dependencias, se reputará agresión ilegítima la entrada indebida en aquélla o éstas.

2º - Necesidad racional del medio empleado para impedirla o repelerla.

3º - Falta de provocación suficiente por parte del defensor.

5 - El que, en estado de necesidad, para evitar un mal propio o ajeno lesione un bien jurídico de otra persona o infrinja un deber, siempre que concurran los siguientes requisitos:

1º - Que el mal causado no sea mayor que el que se trate de evitar.

2º - Que la situación de necesidad no haya sido provocada intencionadamente por el sujeto.

3º - Que el necesitado no tenga, por su oficio o cargo, obligación de sacrificarse.

6 - El que obre impulsado por miedo insuperable.

7 - El que obre en cumplimiento de un deber o en el ejercicio legítimo de un derecho, oficio o cargo.

En los supuestos de los tres primeros números se aplicarán, en su caso, las medidas de seguridad previstas en este Código.


Circunstancias que atenúan la responsabilidad criminal


Art 21

Son circunstancias atenuantes:

1 - Las causas expresadas en el Capítulo anterior, cuando no concurrieren todos los requisitos necesarios para eximir de responsabilidad en sus respectivos casos. (ver arts. 19 y 20)

2 - La de actuar el culpable a causa de su grave adicción a las sustancias mencionadas en el número 2 del artículo anterior.

3 - La de obrar por causas o estímulos tan poderosos que hayan producido arrebato, obcecación u otro estado pasionade entidad semejante.

4 - La de haber procedido el culpable, antes de conocer que el procedimiento judicial se dirige contra él, a confesar la infracción a las autoridades.

5 - La de haber procedido el culpable a reparar el daño ocasionado a la víctima, o disminuir sus efectos, en cualquier momento del procedimiento y con anterioridad a la celebración del acto del juicio oral.

6 - La dilación extraordinaria e indebida en la tramitación del procedimiento, siempre que no sea atribuible al propio inculpado y que no guarde proporción con la complejidad de la causa.

7 -  Cualquier otra circunstancia de análoga significación que las anteriores


Circunstancias que agravan la responsabilidad criminal

Art 22.

Son circunstancias agravantes:

1 - Ejecutar el hecho con alevosía.

Hay alevosía cuando el culpable comete cualquiera de los delitos contra las personas empleando en la ejecución medios, modos o formas que tiendan directa o especialmente a asegurarla, sin el riesgo que para su persona pudiera proceder de la defensa por parte del ofendido.

2 - Ejecutar el hecho mediante disfraz, con abuso de superioridad o aprovechando las circunstancias de lugar, tiempo o auxilio de otras personas que debiliten la defensa del ofendido o faciliten la impunidad del delincuente.

3 - Ejecutar el hecho mediante precio, recompensa o promesa.

4 - Cometer el delito por motivos racistas, antisemitas u otra clase de discriminación referente a la ideología, religión o creencias de la víctima, la etnia, raza o nación a la que pertenezca, su sexo, orientación o identidad sexual, la enfermedad que padezca o su discapacidad.

5 - Aumentar deliberada e inhumanamente el sufrimiento de la víctima, causando a ésta padecimientos innecesarios para la ejecución del delito.

6 - Obrar con abuso de confianza.

7 - Prevalerse del carácter público que tenga el culpable.

8 - Ser reincidente.

Hay reincidencia cuando, al delinquir, el culpable haya sido condenado ejecutoriamente por un delito comprendido en el mismo Título de este Código, siempre que sea de la misma naturaleza.

A los efectos de este número no se computarán los antecedentes penales cancelados o que debieran serlo.

Circunstancia mixta de parentesco

Artículo 23.

Es circunstancia que puede atenuar o agravar la responsabilidad, según la naturaleza, los motivos y los efectos del delito, ser o haber sido el agraviado cónyuge o persona que esté o haya estado ligada de forma estable por análoga relación de afectividad, o ser ascendiente, descendiente o hermano por naturaleza o adopción del ofensor o de su cónyuge o conviviente.

Art. 60

1 - Cuando, después de pronunciada sentencia firme, se aprecie en el penado una situación duradera de trastorno mental grave que le impida conocer el sentido de la pena, el Juez de Vigilancia Penitenciaria suspenderá la ejecución de la pena privativa de libertad que se le hubiera impuesto, garantizando que reciba la asistencia médica precisa, para lo cual podrá decretar la imposición de una medida de seguridad privativa de libertad de las previstas en este Código que no podrá ser, en ningún caso, más gravosa que la pena sustituida. Si se tratase de una pena de distinta naturaleza, el Juez de Vigilancia Penitenciaria apreciará si la situación del penado le permite conocer el sentido de la pena y, en su caso, suspenderá la ejecución imponiendo las medidas de seguridad que estime necesarias.

El Juez de Vigilancia comunicará al ministerio fiscal, con suficiente antelación, la próxima extinción de la pena o medida de seguridad impuesta, a efectos de lo previsto por la disposición adicional primera de este Código.

2 - Restablecida la salud mental del penado, éste cumplirá la sentencia si la pena no hubiere prescrito, sin perjuicio de que el Juez o Tribunal, por razones de equidad, pueda dar por extinguida la condena o reducir su duración, en la medida en que el cumplimiento de la pena resulte innecesario o contraproducente.

Delitos de encubrimiento


Art 451

Será castigado con la pena de 6 meses a 3 años al que, con conocimiento de la comisión de un delito y sin haber intervenido en el mismo como autor o cómplice, interviene con posteriordad a su ejecución, de alguno de los modos siguientes:

  Auxiliando a los autores o cómplices para que se beneficien del provecho, producto o precio del delito, sin ánimo de lucro propio

2.º Ocultando, alterando o inutilizando el cuerpo, los efectos o los instrumentos de un delito, para impedir su descubrimiento.

3.º Ayudando a los presuntos responsables de un delito a eludir la investigación de la autoridad o de sus agentes, o a sustraerse a su busca o captura, siempre que concurra alguna de las circunstancias siguientes:

a) Que el hecho encubierto sea constitutivo de traición, homicidio del Rey o de la Reina o de cualquiera de sus ascendientes o descendientes, de la Reina consorte o del consorte de la Reina, del Regente o de algún miembro de la Regencia, o del Príncipe o de la Princesa de Asturias, genocidio, delito de lesa humanidad, delito contra las personas y bienes protegidos en caso de conflicto armado, rebelión, terrorismo, homicidio, piratería, trata de seres humanos o tráfico ilegal de órganos.

b) Que el favorecedor haya obrado con abuso de funciones públicas. En este caso se impondrá, además de la pena de privación de libertad, la de inhabilitación especial para empleo o cargo público por tiempo de dos a cuatro años si el delito encubierto fuere menos grave, y la de inhabilitación absoluta por tiempo de seis a doce años si aquél fuera grave.

Art 452

En ningún caso podrá imponerse pena privativa de libertad que exceda de la señalada al delito encubierto. Si éste estuviera castigado con pena de otra naturaleza, la pena privativa de libertad será sustituida por la de multa de seis a veinticuatro meses, salvo que el delito encubierto tenga asignada pena igual o inferior a ésta, en cuyo caso se impondrá al culpable la pena de aquel delito en su mitad inferior.

Art 453

Las disposiciones de este capítulo se aplicarán aun cuando el autor del hecho encubierto sea irresponsable o esté personalmente exento de pena.

Art 454

Están exentos de las penas impuestas a los encubridores los que lo sean de su cónyuge o de persona a quien se hallen ligados de forma estable por análoga relación de afectividad, de sus ascendientes, descendientes, hermanos, por naturaleza, por adopción, o afines en los mismos grados, con la sola excepción de los encubridores que se hallen comprendidos en el supuesto del número 1.º del artículo 451

Delitos de imprudencia

Art 142

1. El que por imprudencia grave causare la muerte de otro, será castigado, como reo de homicidio imprudente, con la pena de prisión de uno a cuatro años.

Si el homicidio imprudente se hubiera cometido utilizando un vehículo a motor o un ciclomotor, se impondrá asimismo la pena de privación del derecho a conducir vehículos a motor y ciclomotores de uno a seis años. A los efectos de este apartado, se reputará en todo caso como imprudencia grave la conducción en la que la concurrencia de alguna de las circunstancias previstas en el artículo 379 determinara la producción del hecho.

Si el homicidio imprudente se hubiera cometido utilizando un arma de fuego, se impondrá también la pena de privación del derecho al porte o tenencia de armas por tiempo de uno a seis años.

Si el homicidio se hubiera cometido por imprudencia profesional, se impondrá además la pena de inhabilitación especial para el ejercicio de la profesión, oficio o cargo por un periodo de tres a seis años.

2. El que por imprudencia menos grave causare la muerte de otro, será castigado con la pena de multa de tres meses a dieciocho meses.

Si el homicidio se hubiera cometido utilizando un vehículo a motor o un ciclomotor, se podrá imponer también la pena de privación del derecho a conducir vehículos a motor y ciclomotores de tres a dieciocho meses. Se reputará imprudencia menos grave, cuando no sea calificada de grave, siempre que el hecho sea consecuencia de una infracción grave de las normas sobre tráfico, circulación de vehículos a motor y seguridad vial, apreciada la entidad de ésta por el Juez o el Tribunal.

Si el homicidio se hubiera cometido utilizando un arma de fuego, se podrá imponer también la pena de privación del derecho al porte o tenencia de armas por tiempo de tres a dieciocho meses.


El delito previsto en este apartado solo será perseguible mediante denuncia de la persona agraviada o de su representante legal.

Las conductas de  imprudencia, especialmente en materia de tráfico de vehículos, es combatida habitualmente mediante multas impuestas por las autoridades administrativas

Modifying circumstances of the criminal responsibility



Causes that exempt from criminal responsibility


Art 19


Minors under the age of eighteen will not be criminally responsible under this Code.


When a minor of said age commits a criminal act, he may be liable in accordance with the provisions of the Law that regulates the criminal liability of the minor.


Art 20


Are exempt from criminal liability:


1 - The one who, at the time of committing the criminal offense, because of any psychological anomaly or alteration, cannot understand the wrongfulness of the act or act in accordance with that understanding (see art 60 at the end)


The transitory mental disorder will not exempt from punishment when it had been caused by the subject with the purpose of committing the crime or had foreseen or should have foreseen its commission.


2 - Whoever at the time of committing the criminal offense is in a state of full intoxication from the consumption of alcoholic beverages, toxic drugs, narcotic drugs, psychotropic substances or others that produce analogous effects, provided that it has not been sought for the purpose of committing it or his commission was not foreseen or should have been foreseen, or he is under the influence of a withdrawal syndrome, due to his dependence on such substances, which prevents him from understanding the illegality of the act or acting in accordance with that understanding.


3 - The one who, due to altering perception from birth or childhood, has seriously altered the consciousness of reality.


4 - The one that works in defense of the person or own or other rights, provided that the following requirements are met:


1º - Illegitimate aggression. In case of defense of the goods, the attack on them that constitutes a crime or fault and will put them in serious danger of imminent deterioration or loss will be deemed illegitimate aggression. In case of defense of the dwelling or its dependencies, the wrongful entry in the one or these will be considered illegitimate aggression.


2º - Rational need of the means used to prevent or repel it.


3º - Lack of sufficient provocation by the defender.


5 - Anyone who, in a state of need, injures someone else's legal property or infringes a duty in order to avoid his or her own evil, provided that the following requirements are met:


1º - That the evil caused is not greater than that which is to be avoided.


2º- That the situation of need has not been intentionally caused by the subject.


3º - That the needy person does not have, by his trade or position, the obligation to sacrifice himself.


6 - He who works driven by insurmountable fear.


7 - The one that acts in fulfillment of a duty or in the legitimate exercise of a right, office or position.


In the cases of the first three numbers, the security measures provided for in this Code will be applied, where appropriate.


Circumstances that mitigate criminal liability


Art 21


Extenuating circumstances are:


1 - The causes expressed in the previous Chapter, when not all the necessary requirements are met to exempt from liability in their respective cases. (see arts. 19 and 20)



2 - The guilty party acting because of his serious addiction to the substances mentioned in number 2 of the previous article.


3 - That of acting for causes or stimuli so powerful that they have produced outburst, obstinacy or another passionate state of similar entity.


4 - The guilty party, before knowing that the judicial proceeding is directed against him, to confess the infraction to the authorities.


5 - That the guilty party has proceeded to repair the damage caused to the victim, or reduce its effects, at any time during the procedure and prior to the oral trial.


6 - Extraordinary and undue delay in processing the procedure, provided that it is not attributable to the accused himself and that it is out of proportion to the complexity of the case.


7 - Any other circumstance of analogous significance than the previous ones




Circumstances that exacerbate criminal liability

Art 22.


Aggravating circumstances are:


1 - Execute the act with malice.


There is treachery when the culprit commits any of the crimes against people, using means, modes or forms in execution that tend directly or especially to ensure it, without the risk that for his person the defense could come from the offended.


2 - Executing the act through disguise, with abuse of superiority or taking advantage of the circumstances of place, time or help of other people that weaken the defense of the victim or facilitate impunity for the offender.


3 - Execute the fact by price, reward or promise.


4 - Commit the crime for racist, anti-Semitic or other types of discrimination regarding the victim's ideology, religion or beliefs, the ethnicity, race or nation to which they belong, their sex, sexual orientation or identity, the illness they suffer from or your disability.


5 - Deliberately and inhumanly increase the victim's suffering, causing the victim unnecessary suffering for the execution of the crime.


6 - Act with abuse of confidence.


7 - Take advantage of the public nature of the culprit.


8 - Be a repeat offender.


There is recidivism when, when committing a crime, the culprit has been condemned for an offense included in the same Title of this Code, provided it is of the same nature.


For the purposes of this number, the criminal record canceled or that should be will not be computed.


Mixed kinship circumstance


Article 23


It is a circumstance that may mitigate or aggravate liability, depending on the nature, motives and effects of the crime, being or having been the wronged spouse or person who is or has been linked in a stable manner by a similar relationship of affectivity, or being ascendant, descendant or brother by nature or adoption of the offender or his spouse or partner.


Art. 60


1 - When, after a final sentence is pronounced, a lasting situation of serious mental disorder is observed in the prisoner, which prevents him from knowing the meaning of the sentence, the Prison Surveillance Judge will suspend the execution of the custodial sentence that would have been tax, guaranteeing that you receive the necessary medical assistance, for which you can decree the imposition of a custodial security measure of those provided for in this Code that may not, in any case, be more burdensome than the replaced penalty. If it were a sentence of a different nature, the Penitentiary Surveillance Judge will assess whether the situation of the prisoner allows him to know the meaning of the sentence and, where appropriate, will suspend the execution by imposing the security measures he deems necessary.


The Surveillance Judge shall notify the public prosecutor's office, with sufficient notice, of the next extinction of the penalty or security measure imposed, for the purposes of the provisions of the first additional provision of this Code.


2 - Once the prisoner's mental health has been restored, he will serve the sentence if the sentence has not expired, without prejudice to the fact that the Judge or Court, for reasons of equity, may consider the sentence expired or reduce its duration, to the extent that serving the sentence is unnecessary or counterproductive.

Cover-up crimes

Art 451

He will be punished with the penalty of 6 months to 3 years to those who, with knowledge of the commission of a crime and without having intervened in it as an author or accomplice, intervenes after its execution, in any of the following ways:

1. Helping the perpetrators or accomplices to benefit from the profit, proceeds or price of the crime, not their own profit

2. Hiding, altering or rendering the body, the effects or the instruments of a crime, in order to prevent its discovery.

3. Helping those suspected of a crime to evade the investigation of the authority or its agents, or to escape their search or capture, whenever any of the following circumstances occurs:

a) That the disguised act constitutes treason, murder of the King or Queen or any of their ancestors or descendants, the Queen consort or the Queen's consort, the Regent or any member of the Regency, or the Prince or Princess of Asturias, genocide, crime against humanity, crime against protected persons and property in the event of armed conflict, rebellion, terrorism, homicide, piracy, trafficking in human beings or illegal trafficking in organs.

b) That the favoror has acted with abuse of public functions. In this case, in addition to the penalty of deprivation of liberty, that of special disqualification for employment or public office shall be imposed for a period of two to four years if the disguised crime is less serious, and that of absolute disqualification for a period of six to twelve years if that was serious.

Art 452

In no case may a custodial sentence be imposed that exceeds that indicated for the disguised crime. If the latter is punished with a penalty of another nature, the custodial sentence will be replaced by a fine of six to twenty-four months, unless the concealed crime is assigned a penalty equal to or less than this, in which case the guilty person will be sentenced of that crime in its lower half.

Art 453

The provisions of this chapter shall apply even when the perpetrator of the undercover act is irresponsible or personally exempt from punishment.

Art 454

They are exempt from the penalties imposed on the cover-up those that are of their spouse or person to whom they are linked in a stable way by a similar relationship of affectivity, of their ancestors, descendants, brothers, by nature, by adoption, or related in the same degrees, with the sole exception of the cover-ups that are included in the case of number 1 of article 451

Reckless offenses

Art 142

1. Anyone who, due to serious recklessness, causes the death of another, shall be punished, as a prisoner of reckless manslaughter, with a prison sentence of one to four years.

If the reckless homicide had been committed using a motor vehicle or a moped, the penalty of deprivation of the right to drive motor vehicles and mopeds from one to six years will also be imposed. For the purposes of this section, the conduct in which the concurrence of any of the circumstances provided for in article 379 determined the production of the act will be considered in any case as serious recklessness.

If the reckless homicide had been committed using a firearm, the penalty of deprivation of the right to carry or possess weapons will also be imposed for a period of one to six years.

If the homicide had been committed due to professional recklessness, the penalty of special disqualification will also be imposed for the exercise of the profession, office or position for a period of three to six years.

2. He who for less serious imprudence causes the death of another, shall be punished with a fine of three months to eighteen months.

If the murder was committed using a motor vehicle or a moped, the penalty of deprivation of the right to drive motor vehicles and mopeds may also be imposed for three to eighteen months. It will be considered less serious recklessness, when it is not classified as serious, provided that the fact is a consequence of a serious infringement of the rules on traffic, movement of motor vehicles and road safety, appreciated by its entity by the Judge or the Court.

If the homicide had been committed using a firearm, the penalty of deprivation of the right to bear or possess weapons may also be imposed for a period of three to eighteen months.

The crime provided for in this section will only be prosecutable by reporting the aggrieved person or their legal representative.
